Equipment Rental Agreement THIS AGREEMENT dated this ____ day of ____________ , 2004 Between (The “Renter”) (the Rentee) (Name)______________________________________ AND ATV Action Tours (Address)______________________________________ 12421 Woods Lake Rd __________________________________ Monroe WA 98272
WHEREAS the rentee is the Owner of : ____________________________________ (The “Equipment”) AND WHEREAS the Renter is interested in leasing the Equipment from the Rentee on the terms and conditions as set out in this agreement; AND WHEREAS the Renter and Rentee acknowledge that they will, to the best of their ability, comply with the necessary requirements set out pursuant to the applicable legislation of the Sate of Washington; Rented Equipment The Rentee hereby agrees to rent: _________________________________________ to the Renter. The Renter agrees: (a) that the rented vehicle shall not be used to carry passengers ; (b) not to use the vehicle to push, propel or tow another vehicle, trailer or any other thing; (c) not to remove any part from the ATV including the sand flag; (d) not to use the vehicle for any race or competition; (e) not to use the vehicle for any illegal purpose; (f) not to operate the vehicle in a negligent manner; (g) not to permit the vehicle to be operated by any other person not on this rental agreement; (h) be personally responsible for all damages to the Equipment. Term The rental payment for the Equipment will be in the amount of $______ USA per Day commencing on _________________ at ___________ am/pm and ending _________________ at ___________ am/pm Rent is due in advance of the rental. No refunds will be given for early returns. The renter agrees to pickup and return the equipment at the above address, Between the hours of 6 and 10 pm Tuesday through Sunday. Late Charges The Equipment must be returned at the termination of this agreement. A $20 USD per hour late fee will apply until the equipment is received by the Rentee. Use The Renter shall use the Equipment in a careful and proper manner and shall comply with and conform to all national, state, municipal, police and other laws, ordnances and regulations, in any way relating to the possession, use or maintenance of the Equipment. Security/Damage Deposit The Renter will pay a deposit to the Rentee in the amount of : $____________ (the “Security/damage Deposit”) prior to taking possession of the Equipment. The Security Deposit will be returned to the Rentee at the end of this agreement, less such deductions as provided in this Agreement. The Renter acknowledges that they are fully responsible for all damages to the Equipment however _____________ Initial caused, including loss of the machine. Cleaning Fee The Renter shall return the Equipment clean or be subject to a $25 cleaning fee. Loss or Damage 1. Renter hereby assumes and shall bear the entire risk of loss and damage to the Equipment from any and every cause whatsoever. No loss or Damage to the Equipment or any part thereof shall impair any obligation of the Renter under this agreement which shall continue in full force and effect through the term of the agreement. 2. In the event of loss or damage of any kind whatever to the equipment, the Renter shall pay the full costs of repairs from the repair center selected by the Rentee, or pay the replacement cost of the Equipment. Replacement cost: $_____________ 3. If the sand flag is broken or removed, a $250 roll over fee will be added to the repair costs (if any). 4. Renter is solely responsible for transporting the Equipment in a manner to prevent loss or damage.
Indemnity Renter shall indemnify the Rentee against, and hold Lesser harmless from, any and all claims, actions, suits, proceedings, costs, expenses, damages and liabilities, including attorney’s fees and costs, arising out of, connection with, or resulting from Lessee’s use of the Equipment, including without limitation the manufacture, repair, selection, delivery, transportation, possession, use, operation, or return of the Equipment.
Governing Law This agreement shall be construed and enforced according to the laws of the State of Washington.
The parties hereby indicate by their signatures below that they have read and agree with the terms and conditions of this Agreement in its entirety.
